First Claim
1. A surgical staple comprising:
- a base; and
a pair of legs each extending from an opposite end of the base, each leg comprising;
a proximal portion extending from the base at a bend point;
a distal portion extending from the proximal portion at an angle of between 70 and 110 degrees, the proximal portion and the distal portion lying substantially within a plane, the distal portion including a penetrative portion terminating at a tip, the staple being plastically deformable at the bend point on each leg to bend each leg relative to the base causing each tip to approach the other tip along a substantially arcuate path lying in the plane; and
a compressive portion having a substantially flat inner surface located between the base and the distal portion, the compressive portion having a height greater than that of the distal portion, the heights being measured in a first direction perpendicular to the plane at a position adjacent a junction of the compressive portion and the distal portion.

Abstract
A generally U-shaped surgical staple comprises a base 10 and a pair of generally “L”-shaped legs 12 extending substantially perpendicularly from opposite ends of the base respectively. The legs 12 in use of the staple are bent through approximately 90° relative to the base. To effect a greater compression of the stapled tissue the legs include a penetrative portion 16 adjacent the tip and a compressive structure 30 which, due to its increased height relative to that of the penetrative portion, spreads the compressive forces of the staple further along the length of the incision being closed. The compressive portion also provides a depth stop to avoid the tip penetrating too deeply into the tissue in which it is deployed.

a base; and a pair of legs each extending from an opposite end of the base, the legs and the base being integrally formed of a unitary construction from the same piece of material, each leg comprising; a proximal portion extending from the base at a bend point; a distal portion extending from the proximal portion at an angle of between 70 and 110 degrees, the proximal portion and the distal portion lying substantially within a plane; a penetrative portion terminating at a tip, the staple being plastically deformable at a bend point on each leg to bend each leg relative to the base causing each tip to approach the other leg along a substantially arcuate path lying in a plane; and a compressive portion having a substantially flat inner surface located between the base and the distal portion, the compressive portion having a height greater than that of the penetrative portion, the heights being measured in a first direction perpendicular to the plane defined by the arcuate path at a position adjacent a junction of the compressive portion and the distal portion; wherein the compressive portion is formed on the proximal portion. - View Dependent Claims (12, 13, 14, 15, 16)

a base; and a pair of legs each extending from an opposite end of the base, each leg comprising; a plurality of penetrative portions, each terminating at a tip, the staple being plastically deformable at a bend point on each leg to bend each leg relative to the base causing each tip to approach the other leg along substantially arcuate paths lying in substantially parallel planes; and a compressive portion having a substantially flat inner surface located proximate the base and having a tapered portion extending toward the base from which the compressive portion extends, the compressive portion having a height greater than that of each penetrative portion, the heights being measured in a first direction perpendicular to the parallel planes defined by the arcuate paths. - View Dependent Claims (18, 19, 20, 21)

22. A surgical staple comprising:

a base; and a pair of legs each extending from an opposite end of the base, each leg comprising a proximal portion extending from the base at a bend point, and a distal portion extending from the proximal portion at an angle of between 70 and 110 degrees, the proximal portion and the distal portion lying substantially within a plane, the distal portion including a penetrative portion terminating at a tip and the leg including a compressive portion having a substantially flat inner surface located between the base and the penetrative portion and having a tapered portion extending toward the base from which the compressive portion extends, the compressive portion having a height greater than that of the distal portion, the heights being measured in a first direction perpendicular to the plane at a position adjacent a junction of the compressive portion and the distal portion, the compressive portion being distal the bend point, the legs bendable between; an open position in which the proximal portions of the legs extend substantially linearly from the base and the tips are spaced apart from each other; and a closed position, in which each leg is plastically deformed about the corresponding bend point between the leg and the base such that the proximal portions of the legs are substantially orthogonal to the base, the tips are positioned adjacent one another and the legs lie within the same plane. - View Dependent Claims (23, 24)
