1. A method of determining a maximum rate, comprising:
- determining a normalized average pilot transmit power;
determining a transmit power for a mobile station based on the normalized average pilot transmit power, a pilot reference value, and a ratio of traffic power to pilot power for a rate;
determining a ratio of a maximum transmit power of the mobile station to a headroom for channel variation; and
determining a maximum value for the rate for which the transmit power of the mobile station is less than or equal to the ratio of the maximum transmit power of the mobile station to the headroom for channel variation.

an antenna for receiving and transmitting a plurality of signals; a receiver coupled to the antenna, the receiver receives the plurality of receive signals; a controller coupled to the receiver, wherein the controller is configured to determine a normalized average pilot transmit power from the plurality of receive signals, determine a transmit power for the mobile station based on the normalized average pilot transmit power, a pilot reference value, and a ratio of traffic power to pilot power for a rate, determine a ratio of a maximum transmit power of the mobile station to a headroom for channel variation, and determine a maximum value of the rate for which the transmit power of the mobile station is less than or equal to the ratio of the maximum transmit power of the mobile station to the headroom for channel variation; and a transmitter coupled to the controller, the transmitter conditions the maximum rate for transmission. - View Dependent Claims (6, 7, 8)
