1. A tissue acquisition and fixation system, comprising:
- a staple applying assembly having first and second jaws and a longitudinal axis extending from a proximal end to a distal end thereof, at least one of the jaws being movable such that the first and second jaws have an open position for receiving tissue and a closed position for engaging tissue, the first and second jaws being effective to apply at least one staple in a direction transverse to the longitudinal axis of the staple applying assembly to tissue engaged between the first and second jaws; and
a tissue acquisition member having a second longitudinal axis positioned in a first plane that extends substantially parallel to a second plane containing the longitudinal axis of the staple applying assembly, the tissue acquisition member being effective to engage tissue and to position the engaged tissue between the first and second jaws.

Abstract
Devices and methods are provided for forming and securing a tissue plication. More particularly, the devices and methods of the present invention can be used to create multiple tissue folds on an anterior and posterior wall of a stomach cavity to reduce the volume thereof. In one aspect, a tissue acquisition and fixation system is described that includes a staple applying assembly having first and second jaws, and a tissue acquisition member that extends substantially parallel to a plane running through the first and second jaws. The tissue acquisition member is effective to engage and position tissue between the first and second jaws, and the jaws are effective to apply at least one staple to the tissue engaged therebetween.

an elongate shaft having proximal and distal ends; first and second jaws extending from the distal end of the elongate shaft, at least the first jaw being movable between an open position in which the jaws are configured to receive tissue, and a closed position in which the jaws are effective to engage tissue, and the jaws being effective to apply at least one staple to tissue engaged between the jaws; and a tissue acquisition member coupled to the first jaw and being effective to engage tissue and to position tissue between the first and second jaws; wherein movement of the first jaw between the open and closed position is effective to cause corresponding movement of the tissue acquisition member. - View Dependent Claims (14, 15, 16)
