1. An engaging system for engaging tissue, the engaging system comprising:

  • an engaging element for engaging tissue, said engaging element comprising;

    a first member including at least one tissue engaging portion having a sharpened tip, said sharpened tip extending distally from said first member;

    a second member including at least one tissue engaging portion and being pivotally connected to said first member;

    an elongate aligning portion located on at least one of the first member and the second member, the elongate aligning portion extending along a length and transversely from a surface of at least one of the first member and the second member;

    a pivoting mechanism operatively associated with said first and said second member wherein said pivoting mechanism comprises a pivoting opening located on one of said first member and said second member and a pivoting member located on the other of said first member and said second member, and said pivoting member engaging the pivoting opening;

    a locking mechanism operatively associated with said first member and said second member, said locking mechanism being configured to inhibit relative motion between said first member and said second member; and

    a retaining member, said retaining member comprising a retaining mechanism configured to limit motion of the engaging element both longitudinally through the retaining member and radially about an axis within the retaining member, said retaining member further comprising an aligning mechanism which is operatively associated with said elongate aligning portion, said aligning mechanism being complementary to said elongate aligning portion to receive said elongate aligning portion; and

    an engaging element delivery device, said engaging element delivery device comprising a transitioning member, said transitioning member being configured to transition said engaging element from an open configuration toward a closed configuration,wherein said retaining mechanism is engaged with said pivoting opening to selectably inhibit relative motion between said engaging element and said retaining member.
