1. Apparatus for regulating the function of a patient'"'"'s organ or duct, comprising:
- an elongated member having a first end and a second end;
a fastener disposed on the first end of the elongated member, the fastener configured to engage the second end of the elongated member so that the elongated member forms a loop around the organ or duct;
a tension element disposed for movement within the elongated member;
a drive element associated with and engaging the tension element for causing the tension element to control the tension applied by the elongated member against a patient'"'"'s body organ or duct; and
a release mechanism associated with the tension element and the drive element for selectively releasing the tension element from engagement with the drive element;
and wherein the tension element includes a free end and a fixed end, the fixed end is secured to the drive element via the release mechanism allowing the fixed end of the tension element to be selectively released from the drive element for release of tension being applied by the elongated member, the release mechanism including a jaw mechanism that selectively engages the fixed end of the tension element.

an elongated member having a first end and a second end; a fastener disposed on the first end of the elongated member, the fastener configured to engage the second end of the elongated member so that the elongated member forms a loop around the organ or duct; a tension element disposed for movement within the elongated member; a drive element associated with and engaging the tension element for causing the tension element to control the tension applied by the elongated member against a patient'"'"'s body organ or duct; and a release mechanism associated with the tension element and the drive element for selectively releasing the tension element from engagement with the drive element; wherein the tension element includes a free end and a fixed end, the fixed end is secured to the drive element via the release mechanism allowing the fixed end of the tension element to be selectively released from the drive element for release of tension being applied by the elongated member, the release mechanism includes a jaw mechanism that selectively engages the fixed end of the tension element; and wherein the release mechanism is a fracture mechanism securing the fixed end of the tension element in position and the fixed end of the tension element is secured to an elongated coupling element extending within a shape memory alloy tube, and wherein upon heating or cooling of the shape memory alloy tube, the tube will change shape in a manner fracturing the elongated coupling element and permitting release of the fixed end of the tension element. - View Dependent Claims (11, 12)

an elongated member having a first end and a second end; a fastener disposed on the first end of the elongated member, the fastener configured to engage the second end of the elongated member so that the elongated member forms a loop around the organ or duct; a tension element disposed for movement within the elongated member; a drive element associated with and engaging the tension element for causing the tension element to control the tension applied by the elongated member against a patient'"'"'s body organ or duct; and a release mechanism associated with the tension element and the drive element for selectively releasing the tension element from engagement with the drive element; wherein the tension element includes a free end and a fixed end, the fixed end is secured to the drive element via the release mechanism allowing the fixed end of the tension element to be selectively released from the drive element for release of tension being applied by the elongated member, the release mechanism including a jaw mechanism that selectively engages the fixed end of the tension element; and wherein the release mechanism is a fracture mechanism securing the fixed end of the tension element in position and the release mechanism is associated with a fluid source in conjunction with a fluid filling mechanism applying fluid to a bladder formed in the elongated member upon actuation of the release mechanism.

an elongated member having a first end and a second end; a fastener disposed on the first end of the elongated member, the fastener configured to engage the second end of the elongated member so dlat the elongated member forms a loop around the organ or duct; a tension element disposed for movement within the elongated member; a drive element associated with and engaging the tension element for causing the tension element to control the tension applied by the elongated member against a patient'"'"'s body organ or duct; and a release mechanism associated with the tension element and the drive element for selectively releasing the tension element from engagement with the drive element; wherein the tension element includes a free end and a fixed end, the fixed end is secured to the drive element via the release mechanism allowing the fixed end of the tension element to be selectively released from the drive element for release of tension being applied by the elongated member, the release mechanism including a jaw mechanism that selectively engages the fixed end of the tension element; and wherein the release mechanism is a fracture mechanism securing the fixed end of the tension element in position and the release mechanism is associated with a fluid source that when actuated releases fluid from a bladder formed in the elongated member upon actuation of the release mechanism.
