Abstract

A classification method and system for possible content alteration of a media work may include criteria regarding content that is feasible for alteration. Such criteria may be maintained in records that are accessible to an interested party. Some embodiments may include a record of primary authorization rights applicable to a possible content alteration. A further embodiment feature may include a record of secondary authorization rights applicable to substitute altered content incorporated in a derivative version. Various techniques may be used to incorporate substitute altered content in a derivative version of the media work in accordance with applicable substitution guidelines.

Claims

1. A computer program product, comprising:

at least one non-transitory computer-readable medium including at least;

one or more instructions for identifying at least one of a media asset or a composite media work having a group of related component elements feasible for alteration, including at least one or more instructions for determining a restricted image within the at least one of a media asset or a composite media work, the restricted image including at least an image of at least one human subject;

one or more instructions for obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least means for one or more instructions for obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape;

one or more instructions for confirming that the substitute content complies with one or more applicable alteration guidelines regarding what may be substituted for the group of related component elements; and

one or more instructions for implementing collective incorporation of the substitute content by modifying the group of related component elements in the derivative version with the substitute content.

2. A machine, comprising:

circuitry for identifying at least one of a media asset or a composite media work having a group of related component elements feasible for alteration, including at least circuitry for determining a restricted image within the at least one of a media asset or a composite media work, the restricted image including at least an image of at least one human subject;

circuitry for obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least circuitry for obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape;

circuitry for confirming that the substitute content complies with one or more applicable alteration guidelines regarding what may be substituted for the group of related component elements; and

circuitry for implementing collective incorporation of the substitute content by modifying the group of related component elements in the derivative version with the substitute content.

The machine of claim 2, wherein the circuitry for identifying at least one of a media asset or a composite media work having a group of related component elements feasible for alteration, including at least circuitry for determining a restricted image within the at least one of a media asset or a composite media work, the restricted image including at least an image of at least one human subject comprises:

circuitry for receiving the at least one of a media asset or a composite media work at a social networking website.

4. The machine of claim 3, wherein the circuitry for receiving the at least one of a media asset or a composite media work at a social networking website comprises:

circuitry for receiving the at least one of a media asset or a composite media work at a social networking website, the received at least one of a media asset or a composite media work uploaded to the social networking website via a user account associated with the social networking website.

The machine of claim 2, wherein the circuitry for identifying at least one of a media asset or a composite media work having a group of related component elements feasible for alteration, including at least circuitry for determining a restricted image within the at least one of a media asset or a composite media work, the restricted image including at least an image of at least one human subject comprises:

circuitry for identifying at least one of a media asset or a composite media work associated with capture by a digital image device.

6. The machine of claim 5, wherein the circuitry for identifying at least one of a media asset or a composite media work associated with capture by a digital image device comprises:

circuitry for identifying, using identification logic local to a digital image device, at least one of a media asset or a composite media work associated with capture by the digital image device.

7. The machine of claim 5, wherein the circuitry for identifying at least one of a media asset or a composite media work associated with capture by a digital image device comprises:

circuitry for identifying, using identification logic distal to a digital image device, at least one of a media asset or a composite media work associated with capture by the digital image device.

The machine of claim 2, wherein the circuitry for identifying at least one of a media asset or a composite media work having a group of related component elements feasible for alteration, including at least circuitry for determining a restricted image within the at least one of a media asset or a composite media work, the restricted image including at least an image of at least one human subject comprises:

circuitry for identifying at least one of a media asset or a composite media work having a group of related component elements feasible for alteration, the group of related component elements including at least an image of at least one human subject as a first component element and at least some metadata related to the image of at least one human subject as a second component element.

The machine of claim 2, wherein the circuitry for identifying at least one of a media asset or a composite media work having a group of related component elements feasible for alteration, including at least circuitry for determining a restricted image within the at least one of a media asset or a composite media work, the restricted image including at least an image of at least one human subject comprises:

circuitry for identifying at least one of a media asset or a composite media work including at least determining an image of at least one human subject within the at least one of a media asset or a composite media work, wherein the at least one human subject is associated with a prior preference for anonymity.

The machine of claim 2, wherein the circuitry for identifying at least one of a media asset or a composite media work having a group of related component elements feasible for alteration, including at least circuitry for determining a restricted image within the at least one of a media asset or a composite media work, the restricted image including at least an image of at least one human subject comprises:

circuitry for identifying at least one of a media asset or a composite media work including at least determining an image of at least one human subject within the at least one of a media asset or a composite media work, wherein the at least one human subject is associated with a restriction prohibiting images of the at least one human subject and at least one location portrayed by the at least one of a media asset or a composite media work.

The machine of claim 10, wherein the circuitry for identifying at least one of a media asset or a composite media work including at least determining an image of at least one human subject within the at least one of a media asset or a composite media work, wherein the at least one human subject is associated with a restriction prohibiting images of the at least one human subject and at least one location portrayed by the at least one of a media asset or a composite media work comprises:

circuitry for identifying at least one of a media asset or a composite media work including at least identifying at least one human subject and at least one physical place depicted within the at least one of a media asset or a composite media work, wherein the restriction prohibits images of the at least one human subject at the at least one physical place.

The machine of claim 2, wherein the circuitry for obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least circuitry for obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape comprises:

circuitry for transmitting at least one request for the substitute image via at least one account associated with at least one user of a social networking website; and

circuitry for receiving at least one indication of at least one substitute image via at least one account associated with at least one user of a social networking website.

13. The machine of claim 12, wherein the circuitry for receiving at least one indication of at least one substitute image via at least one account associated with at least one user of a social networking website comprises:

circuitry for receiving at least one indication of at least one image within at least one social networking image gallery associated with at least one social networking user.

The machine of claim 2, wherein the circuitry for obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least circuitry for obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape comprises:

circuitry for obtaining a substitution for an image of at least one body part of the at least one human, wherein obtaining a substitution includes at least obtaining a substitute image including at least a replacement image for the at least one body part, the replacement image having a shared shape with the image of at least one body part of the at least one human.

The machine of claim 2, wherein the circuitry for obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least circuitry for obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape comprises:

circuitry for preparing a substitute image via at least one of blurring or blocking at least one identifying feature of the at least one human subject.

16. The machine of claim 2, wherein the circuitry for confirming that the substitute content complies with one or more applicable alteration guidelines regarding what may be substituted for the group of related component elements comprises:

circuitry for confirming that the substitute content will facilitate replacement of the restricted image while maintaining a general presentation context of the at least one of a media asset or a composite media work.

17. The machine of claim 2, wherein the circuitry for confirming that the substitute content complies with one or more applicable alteration guidelines regarding what may be substituted for the group of related component elements comprises:

circuitry for confirming that the substitute content will anonymize the at least one human subject.

18. The machine of claim 2, wherein the circuitry for confirming that the substitute content complies with one or more applicable alteration guidelines regarding what may be substituted for the group of related component elements comprises:

circuitry for confirming that the substitute content will obscure the identity of the at least one human subject.

19. The machine of claim 2, wherein the circuitry for confirming that the substitute content complies with one or more applicable alteration guidelines regarding what may be substituted for the group of related component elements comprises:

circuitry for confirming that the substitute content will obscure the identity of the at least one human subject upon the substitute content being incorporated into the at least one of a media asset or a composite media work.

20. The machine of claim 2, wherein the circuitry for confirming that the substitute content complies with one or more applicable alteration guidelines regarding what may be substituted for the group of related component elements comprises:

circuitry for confirming that the substitute content complies with at least one of procedural guidelines or consent requirements.

21. The machine of claim 2, wherein the circuitry for confirming that the substitute content complies with one or more applicable alteration guidelines regarding what may be substituted for the group of related component elements comprises:

circuitry for confirming that the substitute content includes at least an image of at least another human subject, the at least another human subject associated with a previous consent related to replacement content which includes at least the at least another human subject.

22. The machine of claim 2, wherein the circuitry for confirming that the substitute content complies with one or more applicable alteration guidelines regarding what may be substituted for the group of related component elements comprises:

circuitry for confirming that an image implementing incorporation of the substitute content will comply with one or more terms of service associated with a website hosting the modified image.

23. The machine of claim 2, wherein the circuitry for implementing collective incorporation of the substitute content by modifying the group of related component elements in the derivative version with the substitute content comprises:

circuitry for incorporating the substitute image having the shared image attribute into the at least one of a media asset or a composite media work.

24. A method, comprising:

identifying at least one of a media asset or a composite media work having a group of related component elements feasible for alteration, including at least determining a restricted image within the at least one of a media asset or a composite media work, the restricted image including at least an image of at least one human subject;

obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape;

confirming that the substitute content complies with one or more applicable alteration guidelines regarding what may be substituted for the group of related component elements; and

implementing collective incorporation of the substitute content by modifying the group of related component elements in the derivative version with the substitute content,

wherein at least one of the identifying, obtaining, confirming, or implementing is at least partially implemented using at least one processing device.

25. The method of claim 24, wherein confirming that the substitute content complies with one or more applicable alteration guidelines regarding what may be substituted for the group of related component elements comprises:

concurring with a determination that the substitute content is in compliance with one or more applicable alteration criteria regarding one or more of the following types of modification of the group of related component elements;

addition, deletion, modification, or replacement.

26. The method of claim 25, further comprising:

utilizing one or more of the following types of approval techniques to make a determination that the collective incorporation in the derivative version is in compliance with the one or more applicable alteration guidelines;

pre-authorization, delegated agent, derivative version review, substitute content review, alteration review, summary characterization, substitute content rating, or aggregate content rating.

27. The method of claim 24, wherein confirming that the substitute content complies with one or more applicable alteration guidelines regarding what may be substituted for the group of related component elements comprises:

concurring with a determination that the collective incorporation in the derivative version is in compliance with one or more of the following types of pre-approved alteration parameters;

substitute component element, substitute designated aspect, substitution process, alternate media format, or alternate distribution channel.

28. The method of claim 24, wherein confirming that the substitute content complies with one or more applicable alteration guidelines regarding what may be substituted for the group of related component elements comprises:

concurring with a determination that the collective incorporation in the derivative version is in compliance with one or more applicable alteration guidelines that include at least forbidding or restricting alteration of one or more of following types of component elements;

plot, story, animation, text, narration, dialog, color, actor, character, clothing, product, sound, music, musical lyrics, product, object, item, or title.

29. The method of claim 24, wherein confirming that the substitute content complies with one or more applicable alteration guidelines regarding what may be substituted for the group of related component elements comprises:

concurring with a determination that the collective incorporation in the derivative version is in compliance with one or more applicable alteration guidelines forbidding or restricting a substitute component element associated with one or more of the following;

profanity, violence, murder, death, disfigurement, sexual behavior, nudity, ethnic slur, criminal activity, drug usage, illegal symbol, proprietary material, discriminatory depiction, defamation, slander, disparagement, dissenting material, specified behavior, specified object, specified item, specified depiction, or specified symbol.

30. The method of claim 24, wherein confirming that the substitute content complies with one or more applicable alteration guidelines regarding what may be substituted for the group of related component elements comprises:

making a determination that the collective incorporation in the derivative version is in compliance with one or more of the following types of applicable alteration criteria;

automatic, contingent, negotiable, tentative, recommended, required, or compensation.

31. The method of claim 24, wherein confirming that the substitute content complies with one or more applicable alteration guidelines regarding what may be substituted for the group of related component elements comprises:

concurring with a determination that the collective incorporation in the derivative version is in compliance with the applicable alteration guidelines regarding the group of related component elements feasible for alteration.

32. The method of claim 31, further comprising:

utilizing one or more of the following types of approval techniques to make a determination that the collective incorporation in the derivative version is in compliance with the one or more applicable alteration guidelines;

programmed, pre-authorization, delegated agent, derivative version review, substitute content review, alteration review, summary characterization, substitute content rating, or aggregate content rating.

33. The method of claim 24, wherein implementing collective incorporation of the substitute content by modifying the group of related component elements in the derivative version with the substitute content comprises:

implementing collective incorporation of the substitute content in the derivative version based on a determination that the group of related component elements feasible for alteration was previously associated with a stated real-world entity or real-world person or real-world venture having one or more of the following characteristics;

lost, dissolved, bankrupt, insolvent, defunct, non-operative, disqualified, in default of obligation, status change, defective right, relinquished right, faulty claim, non-renewal of prerogative, or expired authorization.

34. The method of claim 24, wherein implementing collective incorporation of the substitute content by modifying the group of related component elements in the derivative version with the substitute content comprises:

implementing collective incorporation of the substitute content in the derivative version based on a determination that the group of related component elements feasible for alteration is associated with a stated real-world person who has died or retired or otherwise changed status.

35. The method of claim 24, wherein implementing collective incorporation of the substitute content by modifying the group of related component elements in the derivative version with the substitute content comprises:

implementing collective incorporation of the substitute content in the derivative version in response to a relevant communication received from a stated real-world entity or from a stated real-world person or from a stated real-world venture previously associated with the group of related component elements feasible for alteration.

The method of claim 24, wherein obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape comprises:

obtaining substitute content designated for collective incorporation in one or more of the following types of derivative versions;

original, derived, archived, stored, master, edited, combined, mixed, merged, integrated, dubbed, captioned, subtitled, expurgated, uncut, preview, pre-release, final, special edition, animated, translated, targeted, restricted access, promotional, sponsored, subsidized, contracted release, or specified purpose.

The method of claim 24, wherein obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape comprises:

obtaining substitute content designated for collective incorporation in a derivative version having one or more of the following types of media formats;

analog, digital, VHS, CD, VCD, SVCD, DVD, HD, HD DVD, Blu-ray, MPEG, MP3, reformatted, upgraded, downgraded, future format standard, video snippet, digitized vignette, data compression, or data decompression.

The method of claim 24, wherein obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape comprises:

obtaining substitute content designated for collective incorporation in a derivative version targeted for one or more of the following types of distribution arrangements;

fund-raising, non-profit, theater, airplane viewing, commercial television, public television, pay-per-view, rental, lease, sale, domestic distribution, foreign distribution, exclusive distribution, non-exclusive distribution, foreign language, infomercial, live, real-time, delayed, or on-demand.

The method of claim 24, wherein obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape comprises:

obtaining substitute content designated for collective incorporation in a derivative version to be distributed via one or more of the following types of distribution channels;

Internet, network, cable, satellite, wireless, broadcast, narrowcast, download, upload, shared, concurrent, streaming audio, streaming video, packet switching, or storage media delivery.

The method of claim 24, wherein obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape comprises:

obtaining substitute content designated for collective incorporation in a derivative version targeted for one or more of the following;

geographic area, demographic category, ethnic group, restricted audience, group membership, or subscriber.

The method of claim 24, wherein obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape comprises:

obtaining substitute content having one or more of the following types of designated aspects associated with a real-world entity or real-world person or real-world venture;

brand, trademark, service mark, copyrighted work, name, company name, identity, symbol, commercial symbol, icon, logotype, trade logo, trade dress, packaging, label, emblem, insignia, acronym, abbreviation, certification, slogan, jingle, animation, animated character, copyrighted item, or personage.

The method of claim 24, wherein obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape comprises:

obtaining substitute content having one or more of the following types of designated aspects associated with a real-world entity or real-world person or real-world venture;

livery, color scheme, dress, fabric, jewelry, pattern, design, sculpture, artistic work, person, animal, mascot, character, obscured attribute, highlighted attribute, or avatar.

The method of claim 24, wherein obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape comprises:

obtaining substitute content having one or more of the following types of designated aspects associated with a real-world entity or real-world person or real-world venture;

product, service, invention, accessory, vehicle, place, address, location, store, building, school, university, hospital, church, club, group, organization, or business.

The method of claim 24, wherein obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape comprises:

obtaining substitute content having one or more of the following types of designated aspects associated with a real-world person;

name, face, personal characteristics, identity, residence, title, achievement, occupation, career, role, activity, hobby, rank, medal, badge, award, identification features, biometric attribute, photographic image, voice recording, accent, dialect, recognizable personality trait, gesture, demeanor, mannerism, appearance, clothing, hairstyle, tattoo, accessory, jewelry, piercing, avatar, setting, item possession, or property ownership.

The method of claim 24, wherein obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape comprises:

obtaining one or more of the following types of substitute content;

related set of designated aspects, related set of designated components, identical objects, same object in different scenes, or same object in different settings.

The method of claim 24, wherein obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape comprises:

obtaining substitute content that includes one or more of the following types of related component elements;

textual, verbal, audio, musical, visual, image, simulation, or animation.

The method of claim 24, wherein obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape comprises:

obtaining substitute content that includes one or more of the following types of related component elements;

music, setting, hero, heroine, villain, clothing, vehicle, company, animal, food, product, brand, or dialogue.

The method of claim 24, wherein identifying at least one of a media asset or a composite media work having a group of related component elements feasible for alteration, including at least determining a restricted image within the at least one of a media asset or a composite media work, the restricted image including at least an image of at least one human subject comprises:

identifying a group of one or more of the following types of related component elements;

textual, verbal, audio, musical, visual image, simulation, or animation.

The method of claim 24, wherein identifying at least one of a media asset or a composite media work having a group of related component elements feasible for alteration, including at least determining a restricted image within the at least one of a media asset or a composite media work, the restricted image including at least an image of at least one human subject comprises:

identifying at least one of a media asset or a composite media work having a group of one or more of the following types of related component elements;

related set of designated aspects, related set of designated components, identical objects, same object in different scenes, or same object in different settings.

The method of claim 24, wherein obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape comprises:

obtaining substitute content suitable for incorporation as an integral component of the derivative version.

The method of claim 24, wherein obtaining substitute content for collective incorporation in a derivative version of the at least one of a media asset or a composite media work, including at least obtaining a substitute image to substitute for the restricted image, the substitute image having a shared image attribute with the at least an image of at least one human image, the shared image attribute including a shared shape comprises:
