Update: Judge Upholds $13.7M Award to Boston University in Trial over LED Patent

This week, District Judge Patti B. Saris upheld a jury’s award of $13.7M to the Trustees of Boston University (BU), ruling that the university’s six-year delay in filing suit against Epistar and Everlight Electronics caused no economic harm to the defendants. In November 2015, a Massachusetts jury had found that Epistar and its customers Everlight and Lite-On infringed a BU semiconductor patent (5,686,738) through the manufacture and sale of certain LED products (1:12-cv-11935). Epistar and Everlight were found to have willfully infringed the ‘738 patent and were ordered to pay $9.3M and $4M, respectively, with Lite-On to pay $365K.
