First of a Slew of New DynaIP Plaintiffs Launches Litigation . . . Amid Persistent Confusion
Texas NPE escapex IP LLC has initiated its first litigation, suing Alphabet (Google) (6:22-cv-00428), Apple (6:22-cv-00427), Digital Trends (1:22-cv-03512), Liberty Media (Sirius XM) (6:22-cv-00430), Rockbot (2:22-cv-00130), and Spotify (3:22-cv-00963) across multiple judicial districts. A single patent broadly directed to updating a “dynamic” music album is asserted across the complaints, which target playlist management features in the defendants’ respective music streaming platforms. escapeX IP’s case against Spotify provides yet another example of a plaintiff choosing to file in the Northern District of Texas while apparently ignoring that district’s heightened disclosure requirements, while its suit against “Sirius XM” raises separate questions about what defendant has actually been named there.
