Judge Connolly Invites Parties to Address Court’s Authority to Order Disclosures

Mark your calendar: On December 14, Chief Judge Colm F. Connolly will hear oral argument on VLSI Technology LLC’s response to his order staying the NPE’s Delaware case against Intel until VLSI has complied with his standing order regarding corporate disclosure. That response from VLSI represented that it has already provided the court everything that it knows and can be shared, subject to certain confidentiality agreements. Intel questions that representation. Now, Judge Connolly has invited the submission of supplemental briefs, by December 2, to address a host of issues, including whether the court had the authority to impose its markedly heightened corporate disclosure requirements in the first place and whether the court should dismiss VLSI’s case for the alleged failure to comply with them.
