Red Hat (3:24-cv-04740) has filed a Northern District of California against VirtaMove, Corp. (f/k/a Appzero), seeking declaratory judgments of noninfringement of two virtual file containerization patents that VirtaMove asserted in earlier complaints filed against Red Hat’s parent IBM, as well as against Alphabet (Google), Amazon, HP Enterprise (HPE). Red Hat acknowledges that VirtaMove has yet to name Red Hat’s OpenShift as an accused product but hangs jurisdiction on VirtaMove’s infringement allegations in the prior suits, as “focused on the use and deployment of Kubernetes, Docker, and other open source software programs . . . against the same containerization and container orchestration technologies used in OpenShift”.
