IP Edge Adds New Case to Medical Inventory Management Campaign, as Earlier Suit Enters Claim Construction
Olive Shade LLC has added a case against CenTrak (2:18-cv-00501) to the litigation campaign that it began in June of last year. CenTrak is the seventh defendant against which Olive Shade has asserted the sole patent-in-suit, which broadly relates to using RFID (radio frequency identification) to track medical devices; the defendants are accused of infringement through provision of their medical inventory management solutions (most recently, CenTrak’s Asset Tracking & Management solution). The cases against five of those earlier defendants have already been dismissed, while the suit filed last June against Becton Dickinson (CareFusion) has entered claim construction.

Assignment Records Published in the First Half of August Reflect Ongoing, and Likely Pending, Litigation
RPX took notice, among the USPTO assignment records made available during the first half of August, of transactions involving recently asserted patents (e.g. to an affiliate of IP Edge LLC) as well as at least one assignment suggesting that new litigation is coming (i.e. to Red Dragon Innovations, LLC). August has also seen clean-up activity by Intellectual Ventures LLC in an ongoing automotive campaign.

Past Texas Fixture IP Edge Launches New Litigation Campaign in Delaware
Olive Shade LLC, an apparent affiliate of Texas monetization firm IP Edge LLC, has filed suit against Becton Dickinson (CareFusion) (1:17-cv-00690) and Meps Real-Time (1:17-cv-00689) in Delaware. The complaints assert a single patent (6,861,954) generally related to using RFID (radio frequency identification) to track medical devices; the defendants are accused of infringement through provision of their medical inventory management solutions (IMPRESS Track System and Intelliguard RFID solution, respectively). This litigation campaign is the first to be launched by an IP Edge affiliate outside of the Eastern District of Texas and follows two campaigns by IP Edge affiliates, one brought a week before the US Supreme Court issued its TC Heartland decision on patent venue (by Kaldren LLC in New York) and the other brought three days after that decision (by Venadium LLC in Illinois), in which a round of suits has been added to an existing litigation campaign, begun in Texas, outside of that state.
