PTAB Sees First New IPR Petition Against Native American Tribe as Sovereign Immunity Defense Gets Rejected

In July 2018, the Patent Trial and Appeal Board (PTAB) saw the first new petition for inter partes review (IPR) filed against a Native American tribe since the Board’s March ruling that IPRs against tribes are not barred by sovereign immunity, a decision that was upheld by the Federal Circuit on July 20. Institution decisions were also issued by the Board in July for IPRs against Uniloc Corporation Pty. Limited and Sound View Innovations, LLC, among other notable plaintiffs. In addition, the PTAB issued final decisions throughout July for IPRs against a variety of other NPEs, from Intellectual Ventures LLC (which has continued to pursue its existing campaigns but has seemingly stopped filing new US litigation) to smaller entities like Andrea Electronics Corporation and XPRT Ventures LLC as well as individual inventor Daniel L. Flamm.

Andrea Electronics Files District Court and ITC Complaints, This Time Against Apple and Samsung
Andrea Electronics Corporation (AEC) has rebooted its sole litigation campaign, filing a district court case against Apple (2:16-cv-5220), another against Samsung (2:16-cv-5217), and a complaint before the International Trade Commission (ITC) against both (337-TA-1026). All three new complaints assert identified claims from three patents (6,049,607; 6,363,345; 6,377,637) generally related to interference cancelling and noise reduction. At issue in this campaign are audio processing hardware and software in a host of computing and related products, including laptops, tablets, smartphones, headsets, and wearables.

Andrea Electronics Expands Litigation Campaign, New Targets and New Patent
Andrea Electronics Corporation (AEC) continues its campaign with a new round of lawsuits. The entity asserts a group of five patents (5,825,898; 6,049,607; 6,363,345; 6,377,637; 6,483,923), and filed suit against Acer (2:15-cv-00210), ASUS (2:15-cv-00214), Dell (2:15-cv-00209), HP (2:15-cv-00208), Lenovo (2:15-cv-00212), Realtek Semiconductor (2:15-cv-00215), and Toshiba (2:15-cv-00211). It previously sued Acer, Lenovo, and Toshiba in July 2014, asserting four of the five patents-in-suit (all but the ‘637 patent). Those cases are still open, and the new suits against those defendants assert only the ‘637 patent, while the other recent suits assert all five patents. The patents-in-suit relate to digital signal interference cancelling, and the suits accuse defendants’ personal computer products of infringement.

Fortress-Backed OpCo Turns to Patent Monetization, Filed First Litigation
Acer (2:14-cv-04488), Lenovo (2:14-cv-04489), and Toshiba (2:14-cv-04492) are the first targets in Andrea Electronics Corporation’s (AEC’s) patent litigation campaign that asserts a group of four patents (5,825,898; 6,049,607; 6,363,345; 6,483,923). The patents-in-suit relate to digital signal interference cancelling, and the suits accuse defendants’ personal computer products of infringement. The asserted patents were developed by Lamar Signal Processing and acquired by AEC in 2000.
