Neonode Smartphone LLC, a subsidiary of monetization firm Aequitas Technologies LLC, has sued Apple (6:20-cv-00505) and Samsung (6:20-cv-00507) over the provision of smartphones and tablets, targeting certain user interface gestures, including those for swipe typing (both defendants), accessing control functions (just Apple), and unlocking a device and responding to phone calls (only Samsung). The plaintiff pleads ownership of the two asserted patents, which generally relate to a device user interface that has predefined touch gestures, with publicly traded Neonode, Inc. (NEON) acknowledging a right to receive 50% of net proceeds from the assertion of certain patent assets, including those in suit, pursuant to a sale agreement to Aequitas. Shares of NEON rose by over 40% during intraday trading in response to the filings against Apple and Samsung; however, a close look at the technology and the likely return to NEON suggests that investors may want to do their due diligence.
