LBS Innovations Files Suit Targeting Websites with Store Locators

LBS Innovations filed suit against Alfred Angelo, Ben & Jerry’s, Cheesecake Factory Restaurants, Denny’s, Jo-Ann Stores, Pilot Travel Centers, Safeway, and Where 2 Get It alleging that the defendants’ websites which include store locator features infringe a patent related to providing location-based offers and other information to mobile devices.  LBS has filed four prior suits since March 2011 against over 30 defendants including retailers 7-ElevenBarnes & NobleBPChick-fil-a, and Sally Beauty Supply.  The defendants have been joined in this suit because their infringement arises from the use of store locator features on their websites.  Dennis Hollenberg is the named inventor on the patent-in-suit, which was assigned to LBS in November 2010.  LBS Innovations is one of 19 portfolios controlled by Empire IP, a patent monetization entity managed by Daniel Mitry and Timothy Salmon.  Other notable Empire IP licensing programs include Cuozzo Speed Technologies, DietGoal Innovations, E-Contact Technologies, Rotatable Technologies, and Secor View Technologies.  11/26, Eastern District of Texas, no judge yet assigned, 2:2012cv00735.
