NPE Sues Zynga over Cursor Modification Patents

Lexos Media [NCE] filed suit against Zynga alleging that Zynga’s cursor modification games infringe five patents related to cursor images.  This is the first patent infringement case filed by Lexos Media, but the second action involving the patents-in-suit.  In April 2012 Zynga filed an action for declaratory judgment seeking declarations of invalidity and non-infringement of the same patents-in-suit.  The patents were issued to Comet Systems and later acquired by Lexos Media from ALOT, Inc. (formerly known as MIVA Direct) in October 2009.  According to the complaint filed by Zynga in April, Lexos Media attempted to license its technology to Zynga and other customers in the San Francisco area soon after nationally launching the “AdBull” online advertising product.  7/24, Middle District of Florida, no judge yet assigned but referred to Magistrate Judge Douglas N.
