NPE Linked to Altitude Capital Sues Microsoft over Search Patents

July 18, 2011

Software Rights Archive [NPE] filed suit against Microsoft over four patents related to search techniques.  Software Rights Archive filed a prior suit in 2007 against Google, AOL, IAC, Lycos, and Yahoo.  That case appears to be ongoing against defendants except IAC.  In July 2008, Google, AOL, IAC and Yahoo filed a motion to compel discovery as to Software Rights Archive’s ownership structure and the identity of its controlling stakeholder.  According to the motion, “corporate information about Altitude Capital, the ultimate entity that appears to control both Software Rights Archive and SRA, is also highly relevant to personal jurisdiction over Software Rights Archive.” 7/15, Western District of Washington, 2:2011cv01187.
