Liberty Mutual Files for DJ against NPEs

Liberty Mutual filed an action for declaratory judgment against Phoenix Licensing [NPE] and LPL Licensing [NPE] over two patents related to software for financial product selection and marketing.  Phoenix is controlled by Erich Spangenberg and LPL is the exclusive licensee of the patents-in-suit.  The patents originated with an individual inventor, Richard Libman, and are from the same family.  Phoenix filed two suits in 2011 against defendants including Aetna, Commerce, Frost, HSBC, Liberty, MetLife, Mutual of Omaha, Sovereign, United Health, and associated entities.  Phoenix and LPL have been involved in 17 suits since 2007, nine of which appear to have been actions for declaratory judgment.  8/19, District of Columbia, 1:2011cv01507.
