As Claims Asserted in Bulk Skirt Early Alice Challenges, IP Edge’s Digi Portal Extends Targeted Advertising Campaign

Uber (1:21-cv-00918) has also been sued by Digi Portal LLC, an apparent IP Edge LLC plaintiff, over a family of five patents generally related to delivering customized webpages to Internet users. Uber is accused of infringement through the provision of its website, with features for delivering customized webpages and targeted advertisements to users based on collected information (e.g., demographics or location data). The suit comes as District Judge Maryellen Noreika has denied multiple concurrent motions challenging claims from the five patent under Alice, noting that “it is not an efficient use of the Court’s time to address the patent eligibility of more than seventy claims from the asserted patents—even with purportedly representative groupings—at the motion to dismiss stage, particularly where the parties dispute whether those claims are representative”.

Dominion’s Eureka Database Solutions Keeps Multimedia Search Campaign Alive

Eureka Database Solutions, LLC, an entity associated with Texas monetization and advisory firm Dominion Harbor Enterprises, LLC, has kept alive its litigation campaign over patents from a portfolio picked up in September 2017 from Excalibur IP, LLC. The latest defendant is NICE (Nexidia) (6:20-cv-00197), accused of infringing three of those patents—generally related to annotating and searching multimedia data—through the provision of multimedia search tools, including Nexidia Audio Discovery, Nexidia Search, and Audiofinder. Excalibur IP is a subsidiary of Altaba Inc. (the company formerly known as Yahoo, Inc. prior to the sale of Yahoo!’s operating businesses to Verizon in 2017); its portfolio has seen several divestitures since late 2017, including to NPEs.

IP Edge Ends August with a Filing Spree That Includes New Complaints Across Multiple Ongoing Campaigns

In late August 2019, while IP Edge LLC dropped four brand new litigation campaigns through litigating entities Aristors Licensing LLC (over a patent received from an inventor-controlled entity), Enchanted IP LLC (over a patent received from Huawei), Sonohm Licensing LLC (over patents received from Siemens), and Zyrcuits IP LLC (over a patent received from Linex Technologies, Inc.), the Texas monetization firm also added cases across an even broader set of its many campaigns. Altair Logix LLC, Digi Portal LLC, EncodiTech LLC, Saros Licensing LLC, and Wave Linx LLC—each a Texas plaintiff associated with IP Edge—have all filed cases over the past week.

Digi Portal Expands Targeted Advertising Campaign

Digi Portal LLC has expanded its litigation campaign over a former Yahoo patent, generally related to delivering customized webpages to Internet users. New suits have been filed against Microsoft (LinkedIn) (1:18-cv-01484) and Quotient Technology (1:18-cv-01485) and come as the deadline to answer or otherwise respond to the complaint in the first case, filed against Twitter earlier this year, has been moved to late October. Infringement allegations focus on the defendants’ use of targeted advertising on their respective platforms.

Another Former Yahoo Patent Pops Up in Litigation, This Time Brought by an Apparent IP Edge Affiliate
New Patent Litigation
Digi Portal LLC, an apparent affiliate of Texas monetization firm IP Edge LLC, has filed its first litigation, suing Twitter (1:18-cv-00808) over a single patent generally related to delivering customized webpages to Internet users. The NPE’s infringement allegations focus on the defendant’s generation of a user’s “Twitter home page and Timeline”, with paragraphs 12 through 25 of Digi Portal’s complaint explaining the usefulness and uniqueness of the purported invention and providing citation to the specification of the patent-in-suit for nearly every sentence.
