PJC Logistic’s CodePro Sues Shell Oil and Five Others

CodePro Innovations [NPE] filed suit against Giant Food, Save Mart Supermarkets, Shell Oil, Stop & Shop Supermarket Company, Kroger, and Winn-Dixie Stores, alleging that the defendants’ loyalty card discount and fuel discount programs infringe two patents related to point-of-sale discount codes.  CodePro has filed two prior suits since June 2011 against Blockbuster, JC Penney, Kohl’s, Redbox, and Safeway over the same patents-in-suit.  Excentus filed an action for declaratory judgment against CodePro in June 2012.  The patents were issued to Codesaver International, which assigned them to patent investment entity Mount Hamilton Partners in July 2006.  Mount Hamilton Partners later assigned the patents-in-suit to I2Z Technology in December 2010 before I2Z transferred them to CodePro in February 2011.  8/6, Southern District of Texas, no judge yet assigned, 4:2012cv02351.
