Maplebear (d/b/a Instacart) (4:25-cv-00137) has filed a Northern District of Oklahoma complaint against Fall Line Patents, LLC. It seeks a declaratory judgment of noninfringement for its online marketplace technology as used by certain retail partners, including ALDI and Sprouts Farmers Market. Fall Line has two live menus of prior cases, one filed last summer and one last fall, with a group of defendants in the former mounting a license defense and active motions in both menus challenging the one remaining claim of the sole patent-in-suit under Alice, as ineligibly drawn to the abstract idea of “sending a questionnaire and collecting responses via the Internet”.
