Monument’s File-and-Dismiss Text Message Banking Campaign Tags Comerica
First-Class Monitoring, LLC, an affiliate of Monument Patent Holdings, LLC, has added Comerica (6:17-cv-00580) to its sole litigation campaign following the September dismissal of its case against JPMorgan Chase (6:17-cv-00365). The NPE’s February cases against two other financial services defendants, Bank of America (2:17-cv-00111) and Citigroup (6:17-cv-00110), were dismissed in April and May, respectively. As in those previous cases, Comerica’s text message banking services are at issue in this latest complaint.

Monument’s Text Banking Campaign Proceeds in File-and-Dismiss Fashion, Adding JP Morgan Chase
After quick dismissals in 2017 cases brought against Bank of America and Citigroup in April and May, respectively, First-Class Monitoring, LLC has added JP Morgan Chase (6:17-cv-00365) to its only litigation campaign, begun last October. Neither financial institution defendant had responded to the First-Class Monitoring complaint filed against it, each of which asserted a single patent (6,014,089), generally related to the digital transmission of information using the short message service (SMS) portion of a personal communications system network. Text banking services have been targeted in all three cases.

First-Class Monitoring Settles CalAmp Case, Promptly Sues Citigroup
First-Class Monitoring, LLC has targeted the texting features associated with a second bank’s mobile services. Earlier this month, after seeking a stay to facilitate settlement in the case against CalAmp, the first defendant in the campaign, First-Class Monitoring filed suit against Bank of America (2:17-cv-00111), asserting the same patent (6,014,089) now also at issue in the new case against Citigroup (6:17-cv-00110). The ‘089 patent generally relates to the digital transmission of information using the short message service (SMS) portion of a personal communications system network.

Text Messaging Campaign Hits Bank of America
First-Class Monitoring, LLC, an affiliate of Monument Patent Holdings, LLC, has filed a second suit in the campaign that it began last October with a case against CalAmp (2:16-cv-01211). The new complaint asserts the same patent (6,014,089), generally related to the digital transmission of information using the short message service (SMS) portion of a personal communications system network, against Bank of America (2:17-cv-00111) for the provision of texting options in connection with its mobile banking services. A motion to stay has been entered in the CalAmp case to facilitate settlement.

CalAmp Targeted in Monument’s Latest Campaign
Another recently formed subsidiary of Monument Patent Holdings, LLC has filed suit. First-Class Monitoring, LLC’s new complaint asserts a single patent (6,014,089) generally related to the digital transmission of information using the short message service (SMS) portion of a personal communications system network. The NPE accuses CalAmp (2:16-cv-01211) of infringement through provision of its LMU-800 vehicle tracking product, which it contends sends text messages through a GSM network to convey “movement and position data”.

First of Late Summer Monument Subsidiaries Launches POS Terminal Campaign
The first of the ten or so Texas NPEs formed by Monument Patent Holdings, LLC since mid-August has now filed litigation, asserting a single patent (7,954,701) in two suits, one filed against each of TGI Friday’s (2:16-cv-01119) and Whole Foods Market (2:16-cv-01120). The plaintiff, Millennium Commerce, LLC, pleads ownership of the ‘701 patent, although no assignment to the NPE has been recorded with the USPTO. One member of a somewhat famous family, the ‘701 patent generally relates to a point-of-sale terminal that processes “cash back” transactions, and the accused products are the defendants’ transaction terminals.
