Sable Networks Files Second Case Against Fortinet in the Eastern District of Texas

Earlier this year, SableNetworks, Inc. (as patent owner) and Sable IP, LLC (as exclusive licensee) initiated its sole litigation campaign, filing seven networking suits in either the Eastern or Western District of Texas since. One of those East Texas defendants, Fortinet, filed a motion to transfer the case against it to the Northern District of California, the “home” of both Fortinet and Sable Networks. The deadline to respond to that motion has been twice extended, pushing the deadline to December 23. Last week, however, Sable filed a second suit against Fortinet in the Eastern District of Texas, this time together with Berkshire Partners (Masergy Communications) (5:20-cv-00196), Masergy alleged to be a Delaware corporation with “principal place of business” in Plano, Texas.

Nokia Becomes Seventh Defendant in Sable’s Networking Campaign

Sable Networks, Inc. and Sable IP, LLC (as patent owner and exclusive licensee, respectively) have filed a new case, against Nokia (6:20-cv-00808), in the Western District of Texas wing of their networking litigation campaign. That campaign began in mid-April 2020, hitting Cisco, Juniper Networks, Dell (EMC), and now Nokia in West Texas, as well as Fortinet, Palo Alto Networks, and then HP Enterprise (HPE) (Aruba Networks) in the Eastern District of Texas. District Judge Alan D. Albright has declined to consolidate the first set of cases, setting a January 2020 claim construction hearing in the first-filed case, against Cisco, suggesting that the other defendants could join if so inclined. The East Texas suits have been consolidated, before District Judge Robert W. Schroeder III, with the Fortinet case designated lead.

Sable Sues HP Enterprise
New Patent Litigation
Sable Networks, Inc. and Sable IP, LLC (as patent owner and exclusive licensee, respectively) have filed yet another suit, hitting HP Enterprise (HPE) (Aruba Networks) (5:20-cv-00120) in the Eastern District of Texas, where the plaintiffs have already sued Fortinet and Palo Alto Networks. Sable has also filed suit against Cisco, Dell (EMC), and Juniper Networks in the Western District of Texas, all of the cases asserting patents originating with Caspian Networks (f/k/a Packetcom, LLC). As in the previous cases, Sable targets the provision of various HPE/Aruba networking devices.

Sable Sues Dell in Growing Networking Campaign

Dell (EMC) (6:20-cv-00569) has become the fifth defendant in the new litigation campaign of Sable Networks, Inc. (as patent owner) and Sable IP, LLC (as exclusive licensee) over patents originating with Caspian Networks (f/k/a Packetcom, LLC). The plaintiffs has already targeted networking devices of Cisco, Fortinet, Juniper Networks, and Palo Alto Networks, now adding accusations against certain Dell EMC PowerSwitch N1500, N3000, and N4000 Series devices. Four former Caspian Networks are asserted in the new complaint, with Sable touting the pedigree of one of their named inventors.

Litigation over Former Caspian Networks Patents Expands to Hit Fortinet, Juniper Networks, Palo Alto Networks

Sable Networks, Inc. (as patent owner) and Sable IP, LLC (as exclusive licensee) have added Juniper Networks (6:20-cv-00524) as a Western District of Texas defendant to the campaign that it began in April with a case against Cisco there. The plaintiffs have also sued Fortinet (5:20-cv-00109) and Palo Alto Networks (5:20-cv-00111), this time in the Eastern District of Texas, all of the cases over multiple network traffic management patents, the original development work for which occurred at Caspian Networks (f/k/a Packetcom, LLC), a company formed in 1998 by Lawrence G. Roberts, characterized in the plaintiffs’ complaints as one of the “founding fathers of the Internet”. Various networking devices are the accused products throughout.

Sable Networks Tags Cisco in First Litigation over Former Caspian Networks Patents
New Patent Litigation
Sable Networks, Inc. (as patent owner) and Sable IP, LLC (as exclusive licensee) have sued Cisco (6:20-cv-00288) in the Western District of Texas, targeting the provision of routers and switches that run on certain platforms and software (e.g., Catalyst Supervisor Engine, Cisco IOS XR, Cisco AVC, etc.). The six patents-in-suit generally relate to network traffic management, with development work done by Caspian Networks (f/k/a Packetcom, LLC), a company formed in 1998 by Lawrence G. Roberts, characterized in the new complaint as one of the “founding fathers of the Internet”.
