Former DataPlay Patents Asserted in New NPE’s Blu-ray Campaign

New NPE Sequent Data filed ten infringement suits in a single day against ASUS, Buffalo Americas, Hitachi-LG Data Storage, Panasonic, Pioneer Electronics, Plextor, Memorex, Sony, Toshiba, and Verbatim. Each suit asserts two patents related to recording and formatting data on a storage disk (6,738,333, 7,051,054). The complaints accuse defendants’ Blu-ray writers, burners, and recordable discs of accusing the patents-in-suit. Both patents originated with DataPlay, a failed operating company taken over by DPHI Acquisitions in 2002. DPHI assigned the patents to Enhanced Data Solutions in June 2012. Sequent Data says it is the current owner of the ‘333 and ‘054 patents, but the last assignments on record are between Enhanced Data and Clearwater Innovations in July 2013.
