In January 2021, InnoBrilliance, LLC kicked off its second campaign, suing Sony over the provision of video streaming apps for Playstation and Apple TV devices that allow users to watch multiple channels at once. Subsequent suits focused on makers of smart TVs offering such a “multiview” feature, including those from Samsung, LG Electronics (LGE), and Hisense. However, the plaintiff—an entity linked to AppBrilliance, Inc., and managed by an inventor linked to many other NPEs—has now switched back to streaming apps. In two Southern District of New York complaints, InnoBrilliance accuses FuboTV (1:22-cv-06143) and MLB (1:22-cv-06068) of infringement over multiview-enabled streaming apps as used with Apple TV devices (both defendants) and Hisense smart TVs (FuboTV)—with both apps previously at issue in some of InnoBrilliance’s earlier suits.
